Prosecutor Rich Montecalvo said Alex Zivojinovich's scheduled arraignment today is to be continued because the State Attorney's Office hasn't yet decided what charges, if any, to file against Zivojinovich. He said more investigation into the case needs to occur before this determination can be made.

The Sheriff's Office initially files charges, but it is up to the State Attorney's Office which ones to pursue, if any.

Zivojinovich's lawyer, Jerry Berry, has filed a written not guilty plea on behalf his client so Zivojinovich wouldn't be required to show up in court at the arraignment, whenever that is held.

Berry also has gone on a strong offensive even before the state has decided whether to file formal charges.

He requested and was granted a subpoena last week by Collier Circuit Judge Lauren Miller to force the Ritz hotel to turn over surveillance tapes and several guest lists covering the night of the altercation.

"The defendant has a good faith belief that some or all of the incident in question may have been captured by surveillance cameras owned and maintained by the Ritz-Carlton Hotel Company," Berry's motion states.

Well, let me put my two cents in on the charges that may potentially be charged against Alex. I figure after spending $100,000 for law school I can lend my expertise to my friends at by-tor.com. It may in fact be a good sign that Alex hasn't been charged yet. His arraignment has been stayed (postponed) twice already. The State Attorney is still "investigating" the case. Alex rebutted the charges by hinting that he may file charges against the Police Department. Regardless of all of that, a normal arraignment should not be postponed so many times by the prosecution. Normally, there is clear evidence supporting the charges and the arraignment is merely a technicality. I hope that the State Attorneys Office is pondering whether or not charges would be appropriate in this situation.

Hey, t, I didn't see that pic at first. Of COURSE any al-gal can drool over that grin. It's heart-stopping in it's absolute charm and humanity.

What a guy. I hope all turns out well for his family and all involved.

The guy has a special place in my heart and soul. I think if I "fawned" over him more in this forum I might overdo it.

His musicianship and craft speak so much for themselves. It's so much that he's given himself to us through is passion and artistry.

Plus he's a MAGICIAN that SPINS around in concert.

Alex's arraignment was postponed yet again while the State Attorney's Office contemplates whether or not to press charges. The new arraignment date is March 22.

So, what's he doing while he's waiting for his arraignment? Is there a limit to how long it can wait, besides the statute of limitations?

Someone told me that it looks like an active plea bargain.
